Who can order

You must be at least 18 years old, or have the permission of a parent or guardian who agrees to these terms on your behalf, to place an order. By ordering, you confirm that the payment method you're using belongs to you or that you have permission to use it.

Products, pricing, and availability

Most of what we sell is limited, and a significant portion is one of one. Once a piece sells, we may never carry it again. Inventory shown on the site reflects what we physically have — when it's gone, the listing comes down.

We work to display colors and details accurately, but screens vary. Rhinestone placement, embroidery, and hand-finished detail carry small variations from piece to piece. That variation is part of the product, not a defect.

Prices are listed in US dollars and can change at any time without notice. We're not obligated to honor a price that was published in error. If a pricing mistake affects an order you've already placed, we'll contact you before charging your card and give you the choice to confirm at the correct price or cancel for a full refund.

Order acceptance and our right to refuse

Your order is an offer to buy, not a completed sale. We accept it when we ship it. We may refuse, cancel, or limit any order — including after you receive an order confirmation email — for reasons that include suspected fraud, a payment method we can't verify, a pricing or listing error, quantities we believe are intended for resale, or a shipping address we can't ship to. If we cancel, you get a full refund.

Payment

Payment is captured when you place your order. We accept the methods shown at checkout. You're responsible for any sales tax, which is calculated at checkout based on your shipping address.

If a payment is reversed or a chargeback is filed while an order is in progress, we may cancel the order and hold shipment until the dispute is resolved.

Shipping and risk of loss

Delivery times, rates, and carrier terms are covered in our shipping policy. Title and risk of loss pass to you when the carrier accepts the package.

Returns

All sales are final. We don't accept returns or exchanges for change of mind or fit. Damaged, defective, and incorrect items are covered — full terms and the 7-day claim window are in our refund policy, which is part of these terms.

Intellectual property and third-party marks

The Cap Cartel name, logo, site design, photography, and written content belong to Cap Cartel LLC and may not be copied, scraped, or reused without written permission.

Team names, league marks, brand names, and logos appearing on products or in listings are the property of their respective owners. Cap Cartel is an independent retailer. Unless a listing says otherwise, we are not affiliated with, sponsored by, or endorsed by any league, team, or brand whose marks appear on the goods we sell.

Content you post

If you submit a review, comment, photo, or tag us in content, you grant us a non-exclusive, royalty-free, worldwide license to use, display, and repost that content in our marketing, including on social media and this site, with credit where practical. You confirm the content is yours to license and doesn't infringe anyone else's rights.

We may remove any submitted content for any reason, and we don't guarantee that reviews or comments will be published.

Email and SMS

If you opt in to marketing emails or text messages, you're agreeing to receive recurring automated messages from us. Message and data rates may apply. Reply STOP to any text to unsubscribe, or HELP for help. Unsubscribing from marketing doesn't stop transactional messages about orders you've placed.

Acceptable use

Don't use the site to break the law, infringe anyone's rights, or interfere with how it works. That includes:

• Scraping the site or placing orders with bots or scripts
• Attempting to access accounts or systems you don't own
• Uploading malicious code
• Reselling our products in a way that implies you're an authorized dealer

Disclaimers

The site and everything on it is provided "as is" and "as available," without warranties of any kind, express or implied, to the fullest extent the law allows. We don't warrant that the site will be uninterrupted, error-free, or free of harmful components, or that product descriptions and other content are complete or current.

Limitation of liability

To the fullest extent permitted by law, Cap Cartel LLC and its owners, employees, and suppliers are not liable for indirect, incidental, special, consequential, or punitive damages arising from your use of the site or any product bought through it. Our total liability for any claim is limited to the amount you paid for the order the claim relates to.

Some jurisdictions don't allow certain limitations, so parts of this section may not apply to you.

Indemnification

You agree to indemnify and hold harmless Cap Cartel LLC from any claim or demand, including reasonable attorneys' fees, arising out of your breach of these terms or your violation of any law or third-party right.

Governing law and disputes

These terms are governed by the laws of the State of Texas, without regard to conflict-of-law rules. Any dispute will be brought in the state or federal courts located in Ector County, Texas, and you consent to that jurisdiction.

Changes to these terms

We may update these terms at any time. The version posted here when you place an order is the version that applies to that order. Continuing to use the site after changes are posted means you accept them.
